Zusammenfassung
Dieser Beitrag beschäftigt sich mit Fragen, die im Zusammenhang mit Scheidungsproblemen auftauchen, wenn der Kontakt zwischen Kindern und dem getrennt lebenden Elternteil (Umgang) geklärt werden muss. Der Kernkonflikt besteht hierbei im Streit um das juristisch und psychologisch zu klärenden Verhältnis von Kindeswohl und Kindeswille. Es wird eine Auseinandersetzung versucht mit den in den Gesetzen und psychologischen Theorien enthaltenen Denkweisen. Von besonderer Bedeutung, im Zusammenhang mit dem Kindeswillen, sind hier vor allem die beiden zentralen psychologischen Ansätze des PAS (Parental Alieniation Syndrome) und die Bindungstheorie.
Summary: On the relationship between legislation and psychological theories in dealing with separation and divorce
This paper deals with issues arising in connection with problematic circumstances of divorce when the contact between children and the parent living apart needs to be clarified. The core conflict is about the controversial issue of the child’s well-being and his or her own will. The difference between legal and psychological ways of thinking is worked out. The analysis focuses on two central psychological theories, which prevail in relation to the problem of how to respect the child’s intentions: the theory of PAS (Parental Alieniation Syndrome) and the theory of attachment.
